These Terms of Service ("Terms") govern access to and use of this Pixieset client gallery and any related services provided by the photographer ("Photographer," "we," "us"). By accessing this gallery, downloading images, or placing an order, you agree to these Terms.

1. Copyright & Ownership

All photographs remain the exclusive property of the Photographer and are protected under U.S. and international copyright laws. No ownership rights are transferred to the client.

2. Usage License

Unless otherwise stated in a written agreement, clients are granted a non-exclusive, non-transferable license to use delivered images for personal use only.

Personal use includes:

• Personal websites and portfolios

• Social media (with credit when possible)

• Printing for personal display

The following are not permitted without written consent:

• Commercial, editorial, or advertising use

• Sale, licensing, or redistribution of images

• Use by third parties (brands, venues, publications)

Commercial usage and extended licensing are available upon request and may require additional fees.

3. Image Alteration

Clients may not alter images in a way that misrepresents the Photographer’s work.

Prohibited alterations include:

• Applying filters or heavy edits

• Changing colors, cropping excessively, or removing watermarks

• Using AI tools to modify or re-render images

Basic cropping for social media sizing is permitted.

4. Downloads & Archiving

Clients are responsible for downloading and backing up their images. The Photographer does not guarantee long-term gallery storage.

Galleries may be removed after the stated expiration date. Re-uploading or re-delivery of files may incur a fee.

5. Turnaround & Delivery

Delivery timelines are estimates unless otherwise stated in writing. The Photographer is not responsible for delays caused by circumstances beyond their control.

6. Print Orders

Prints and products ordered through Pixieset are fulfilled by third-party labs.

• Color variation may occur due to screen calibration and print processes

• The Photographer is not responsible for lab errors, shipping delays, or damages during transit

Any issues with print orders must be reported within 7 days of receipt.

7. Model Release & Portfolio Use

Unless otherwise agreed in writing, the Photographer retains the right to use images for:

• Portfolio and website display

• Social media and marketing

• Submissions, promotions, and competitions

If you wish to opt out of promotional use, this must be requested in writing prior to the session.

8. Privacy

Client information is kept private and will not be sold or shared, except as required to deliver services or comply with the law.

9. Limitation of Liability

The Photographer’s liability is limited to the amount paid for the services. The Photographer is not liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles.

11. Acceptance of Terms

By accessing this gallery, downloading images, or placing an order, you acknowledge that you have read, understood, and agree to these Terms of Service.
